Recently, we received a favorable first-instance judgment in a trademark infringement and unfair competition case, in which we represented Donlim, a leading manufacturer and supplier of high-quality electric appliances, a subsidiary of Guangdong Xinbao, one of top 500 private enterprise manufacturing industries in China.

 

In this case, the defendants used ‘Donlim’ ‘Donlim Electrical Appliance’ in various electrical appliances, such as cooking pots, electric hot pots and other electric cookware goods. Besides, they were used in commodity advertisements. All of these infringing behaviors not only severely affected the plaintiff’s goodwill but also infringed exclusive IP rights. Based on the popularity of Donlim and the scale of the defendant's infringement, the judgement awarded damages of 3.2 million RMB (US$500,000), and ordered the defendants to publish an apology statement on its online store in Tmall, 1688, Jingdong and Pinduoduo platforms.
