One highlight of this case was that the infringing products were sold through a WeChat mini-program. As a widely used E-commerce platform, collecting evidence and protecting rights on it has been a nationwide spotlight. In this case, the sales data was not stored by the platform, which rendered a proving barricade for the our client. As hard as it is, we managed to obtain it. By applying for the court investigation order, we collected crucial sales data from the technical support company of WeChat.

Additionally, the trademark authorization chain of the case is complex, and different roles in the collaboration of defendants result in different infringement liability. During the trial, the court carefully reviewed the authorization documents and took the sales data and product authentication results into consideration. Eventually, the defendants’ infringement was confirmed and they shall jointly compensate our client a total of 730,000 Yuan（approx. USD 102,000）.
