On January 19, 2024, Funto received a successful judgement from Guangzhou Intellectual Property Court, which regarding the  trademark and unfair competition dispute case we represented Guangdong Dongpeng Holding Co., Ltd.,(广东东鹏控股股份有限公司) and  Foshan Dongpeng Sanitary Ware Co., Ltd.,(佛山东鹏洁具股份有限公司) against the defendant Zhongshan Dongpeng Electric Co., Ltd.(中山市冻鹏电器有限公司）whose former name is Guangdong Dongpeng Electric Co., Ltd.(广东东鹏电器有限公司）and the relevant shareholders.

The defendant in this case utilized logos that were similar to the plaintiff's “ ”trademark on various electrical products, including range hoods, stoves, disinfection cabinets, water heaters, and others. The court recognized the plaintiff's  No. 1213479 and No. 1212844 trademarks"” as well-known and eligible for protection across different categories. Consequently, the defendant was prohibited from using the infringing trademark on range hoods, stoves, and other electrical products. The main challenge of this case lies in determining the liability of  the relevant shareholders as the actual controller. Through our preliminary investigation and collection of evidence a, we presented sufficient evidence to establish that the relevant shareholders should be held accountable for this infringement.. Based on the scale of the defendant's infringement, the court fully supported our litigation claim, ruling that the defendant compensate us for a total of RMB 5.2 million (about USD722,854), covering both economic losses and reasonable expenses for rights protection.
